Receiverships
Court-appointed control of assets and entities.
A receivership is a legal remedy in which a court appoints a neutral third party—known as a receiver—to take possession, control, preserve, manage, or liquidate property that is the subject of a dispute.
Sparks Law represents businesses, creditors, property owners, lenders, bankruptcy trustees, and court-appointed receivers throughout Texas in receivership matters. We assist clients with the appointment, administration, and litigation of receiverships involving distressed businesses, commercial property, and other complex assets.
When Is a Receiver Appropriate?
A Texas court may appoint a receiver in a variety of circumstances, including:
- Business ownership and partnership disputes
- Shareholder and member disputes involving closely held companies
- Fraud or misappropriation of business assets
- Enforcement and collection of judgments
- Preservation of real property or other valuable assets
- Insolvency or financial distress
- Deadlock among business owners
- Dissolution or winding up of a business
- Other situations where property is in danger of being lost, removed, or materially injured
Because receivership is considered an extraordinary remedy, courts generally require evidence demonstrating that less restrictive remedies are inadequate.
